Terms and Conditions
This contract describes the general terms and conditions (hereinafter referred to as the "Terms and Conditions") to which all individuals defined as "User" will be subject, applicable to the use of the products offered through the website. https://enature.com.mx (hereinafter referred to as the "Website" or the "Site") which is owned by the commercial company named Vaserco, S. de R.L. de C.V. (hereinafter referred to as "Enature"), located at Calle San Carlos number 21, Colonia San Juan de Ocotán, Zapopan, Jalisco, C.P. 45019, a company dedicated to the marketing of natural and organic products with a presence throughout the Mexican Republic.
1. OBJECT. The purpose of the Terms and Conditions is to regulate the commercial relationship between Enature and the User regarding the sale of products offered and made available for free choice by Users through the Website.
Accessing the Site constitutes the User's consent to use it, as well as the products and content without contravening current legislation, good faith, and public order. Violations of these Terms and Conditions of Use, or the omission of acts by the User that, in Enature's opinion, constitute abusive, harmful, or illegal conduct, will give Enature the right to immediately deny access to the Website and/or the provision of Services to the User. PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY, AND IF YOU DO NOT AGREE, PLEASE DO NOT REGISTER YOUR DATA AS A CUSTOMER OR DISTRIBUTOR, AND REFRAIN FROM USING THE SITE.
The User is informed that Enature may manage or administer the Website directly or through a third party, which does not modify in any way the provisions established in these Terms and Conditions.
2. USER. The use of the Website, as well as the marketing and sale of products, will only be available to those with the legal capacity to contract, either on their own or through the corresponding guardian or legal representative. If you are using the Website as a legal entity (company or organization), you must be authorized by it to carry out transactions on behalf of that entity on the Site.
The User agrees to provide lawful and truthful information in the forms enabled on the Website, in which the User must provide certain data or information for the marketing of the products offered by the Site. In any case, the User will immediately notify Enature of any fact that may suggest the improper use of the information registered in such forms, such as theft, loss, or unauthorized access to accounts and/or passwords, in order to proceed with their immediate cancellation.
3. ACCEPTANCE OF TERMS. Visiting, accessing, participating, providing data, using, and navigating the Site implies that the User has read, understood, consented to, and fully and expressly accepted the Terms and Conditions of Use set forth herein.
4. ACCESS AND NAVIGATION ON THE WEBSITE. Enature does not guarantee in any way the continuity and availability of the content and products offered through the Website; however, Enature will carry out the actions that, according to its capabilities, allow it to maintain the proper functioning of the Website, without this implying any responsibility on its part.
Similarly, Enature will not be responsible nor guarantees that the content or software accessible through the Website is free of errors, malware, or that it will not cause any damage to the software or hardware of the device through which the User accesses the Website.
The User may only use the Website for the marketing of products and is obliged to refrain from using it for illegal purposes or contrary to the provisions of this contract, which may harm the rights or interests of third parties, or that may in any way damage, cyberattack, disable, and/or hack in order to overload or deteriorate the Website and/or the products. It is the User's responsibility to verify the HTTPS security certificate of the domain https://enature.com.mx to confirm the authenticity of the site they are visiting.
5. PRODUCTS. Information about the products is available on the Website and is provided in accordance with Chapter III of the Federal Consumer Protection Law.
All reasonable measures will be taken to ensure that the details, descriptions, and images of the products appearing on the Website are correct at the time they are entered into the system. However, to the extent permitted by applicable law, we do not guarantee that such details, descriptions, and images of the products are accurate, reliable, complete, or free of errors.
6. PURCHASE POLICY.
a) PRICE. All prices of the products published on the Website are shown in Mexican pesos, the legal tender in the Republic of Mexico, including the Value Added Tax (I.V.A.), and the prices indicated on the Website or those that may be available through any distribution center at the time of purchase will apply.
The prices shown on the Website may vary in case of promotions or discounts that Enature determines from time to time.
b) PAYMENT. For purchases on the Website, payment will be made at the end of the selection process of the product(s), following the instructions indicated on the Website, and will be configured through the following modalities: payment with a bank card, PayPal, SPEI transfer, Mercado Pago, or bank counter deposit. For physical purchases, payment must be made at the time of purchase, either in cash or by bank card. c) DELIVERY. The estimated delivery time is 15 business days, counted from the moment the online purchase is made. At the time of purchase through the Website, Enature will send a confirmation email to the User, sharing a tracking guide for the shipment, as well as the designated courier.
The product will be delivered to the address that the User establishes for this purpose and cannot be modified once the purchase is made.
d) RETURNS. The User will have a period of 15 calendar days, counted from the receipt of the product, to return it to Enature in case of dissatisfaction. Once this period has elapsed, it will be understood that the User expresses their agreement and complete satisfaction regarding the purchase made and will not be able to demand any refund.
For the purpose of returns within the previously established period, the product must be in perfect condition, with its corresponding label and packaging. Damaged products are not eligible for a refund.
e) RETURN PROCEDURE. The User, in order to request the return of the product, must submit their request through the Website, including: their contact information, a brief description of their case, the receipt or proof of payment, and a bank account number for the refund. Once the request is made, a package ID will be generated for the item to be returned, in order to track it if necessary. The User must cover the shipping costs for the return. After verifying the information, Enature will send the User an email to notify them of the approval or rejection of their refund; if approved, Enature will have a period of 15 calendar days to process the refund to the bank account indicated by the User. For the return of damaged products (broken or cracked pieces), the User must follow the same guidelines, and Enature must replace the damaged product with a new one with the same characteristics (the delivery time may vary depending on its availability in stock).
The User must not return the product until they have received the express authorization from Enature. It is understood that if they do so without prior authorization, it will be at their own risk, releasing Enature from any liability for damages or losses that this may cause to the User.
f) FORCE MAJEURE AND UNFORESEEABLE EVENTS. In the event that Enature is unable to deliver the product to the User within the established timeframe due to an event of force majeure or unforeseeable circumstances beyond its control, it shall not be considered a breach, and therefore it will not be liable for any damages or losses resulting from such event.
7. LIMITATION OF LIABILITY. Under no circumstances shall Enature be liable for direct, indirect, incidental, consequential, or punitive damages resulting from any aspect of the User's use of the Website, whether the damages arise from the use or misuse of the platform, or from the inability to use it, or from the interruption, suspension, modification, alteration, or cancellation of the Site.
8. PRIVACY NOTICE AND PERSONAL DATA PROTECTION. In accordance with Mexican legislation, Enature is committed to adopting the necessary measures within its reach to ensure the privacy of the collected personal data, in such a way that their security is guaranteed, and to prevent their alteration, loss, or unauthorized processing.
The User freely and expressly accepts and consents that the information, documentation, and personal data (the “Personal Data”) provided or that may be voluntarily provided in the future to Enature through the Website, will be subject to processing and incorporated into a database that will be under the responsibility of Enature, with the aim of adequately providing the Services offered through the Website. The processing of personal data will be based on the provisions of Enature's Comprehensive Privacy Notice, which is available on the Website.
9. INTELLECTUAL PROPERTY. Enature holds all industrial property rights of the Website, including the source code, distinctive signs, graphics, images, audio or video files, logos, trademarks, color combinations, structures, designs, and other elements that distinguish the brand and its products, which are protected by the Federal Law for the Protection of Industrial Property and its regulations. The User is strictly prohibited from reproducing, distributing, or disseminating the contents on the Website without prior written authorization from Enature.
The User shall refrain from deleting, altering, or manipulating any file, element, or content of the Website, as well as making changes aimed at compromising the security, files, or databases that are protected.
The User acknowledges that the use of the Website is for personal use only and does not grant any ownership or rights over its intellectual property. In this regard, Enature reserves the right to block, suspend, and/or deny access to the Account of any User or prohibit access to the Website and its content if Enature, at its sole discretion, believes that the User is in violation of these Terms and Conditions and/or is misusing the Website.

10. SEVERABILITY. If any provision of these Terms and Conditions is found to be illegal or void, that provision may be excluded from this instrument and will not affect the validity and enforceability of the remaining provisions.
The absence of action by Enature against the User for any breach related to these Terms and Conditions does not imply a waiver by Enature to take any legal action at any time, nor does it imply acceptance of such breach.
11. INDEMNIFICATION. In addition to any other applicable indemnification under these Terms and Conditions or by law, the User agrees to indemnify, defend, hold harmless, and release Enature and any related parties from any claims, liabilities, expenses, and damages, including attorney's fees and costs, made by third parties related to: (a) the use or attempted use of the Platform that violates these Terms and Conditions; and (b) the violation of any law or rights of third parties by the User during their use of the Website.
12. MODIFICATIONS. Enature reserves the right to make, at any time, modifications or updates to these Terms and Conditions, to address internal policies or new requirements for the provision or offering of its products and services, or for business practices. Therefore, it is the User's obligation to periodically review these Terms and Conditions.
13. APPLICABLE LAW AND JURISDICTION. These Terms and Conditions will be governed and interpreted in accordance with the applicable current Mexican legislation. The User and Enature agree that if any controversy, dispute, or conflict arises related to these Terms and Conditions, the parties submit to the jurisdiction of the competent Courts and Tribunals of the First Judicial District in the State of Jalisco.
